By Law No 25 February 2010 36 has changed the rules on penalties relating to discharges of wastewater, and Article 1 of the said law, changing the first sentence of paragraph 5 of Article Legislative Decree 137 of 3 April 2006, No 152 containing the "Environmental Regulations" stipulates that "Anyone in relation to substances listed in Table 5 of Annex 5 to the third part of this decree, the making of a discharge of industrial waste water is greater than the values limits given in Table 3 or in the case of discharge on the ground, in Table 4 of Annex 5 to the third part of this Decree, or the limits more 'restrictive set by the provinces or autonomous regions or by the' competent authority pursuant to 'Article 107, paragraph 1, and' punished with imprisonment for up to two years and a fine of three thousand to thirty thousand € € .
The new law, in force since March 27, 2010, has substantially reshaped the penalties for discharges of industrial waste water which exceed the limit, restricting criminal liability to more serious cases, is, in fact, limited the application of sanctions prosecutions where the limit is exceeded tabular values \u200b\u200breported only to 18 most dangerous substances set out in Table 5.
