The State Council has recently addressed the issue of unusual offerings, with reference to the scope of intervention ammninistrativo the court.
With No Judgement 28.10.2010 7631 V SEZ, the State Council said that " justification of the assessment about the anomaly of bids in a tender for public work is the decisive factor for the purposes of judicial review, as it allows control over the same logic, with no possibility for the court to replace the PA or transcends measure with the tests that belong to the substance of administrative .
He also stated that " the review of the administrative court reviews the technical appraisal of expression must be limited to formal control of the reasoning nell'attività amministrativa; esso deve pure estendersi, ove necessario ai fini della verifica della legittimità della statuizione gravata, al controllo dell'attendibilità delle operazioni tecniche, sotto il profilo della loro correttezza quanto ai criteri tecnici e relativo procedimento applicativo, fermo restando che esula dalla competenza del giudice amministrativo il riesame delle autonome valutazioni dell'interesse pubblico, compiute dalla p.a. sulla base delle cognizioni tecniche acquisite ”.
In pratica in tema di anomalia, compito primario del giudice resta quello di verificare se il potere amministrativo sia stato tecnicamente esercitato in modo conforme ai criteri di logicità, congruità, rational and proper appreciation of the facts.
